These Terms & Conditions ("Terms") govern your use of twjtrades.com and your purchase and use of products and services provided by TWJ Trading PTY LTD ("TWJ Trading", "we", "us" or "our").

By purchasing or using our paid services, you agree to these Terms and any additional terms disclosed at or before purchase.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to purchase or participate in our programs.

2. Our Services

TWJ Trading provides educational products and services relating to trading, trading strategies, market analysis, risk management, trading psychology, discipline and related subjects.

Depending on the program purchased, services may include:

• pre-recorded educational video modules;
• education regarding trading strategies and methodologies;
• trading psychology and performance education;
• risk-management education;
• group educational/coaching sessions;
• 1-to-1 educational coaching and performance-review sessions;
• community access; and
• educational resources, worksheets, templates and tools.

The specific inclusions, duration and access applicable to your purchase are those disclosed at or before purchase.

3. Educational Nature of Services

TWJ Trading's services are provided for educational and informational purposes.

Unless expressly stated otherwise and provided under appropriate authorisation, TWJ Trading does not provide personal financial product advice. Our educational content and coaching have not been prepared taking into account your individual objectives, financial situation or needs.

1-to-1 coaching may include education concerning trading concepts, strategy execution, risk management, trading psychology, discipline, historical trades and implementation of educational material. It should not be understood as a recommendation that you acquire, dispose of or hold a particular financial product.

You remain responsible for your own trading and financial decisions.

4. Trading Risk

Trading futures, derivatives and other financial products can involve substantial risk and may result in financial loss.

Past performance is not a reliable indicator of future performance. Testimonials, trading results, payouts and examples represent individual circumstances and must not be interpreted as guarantees of future results.

5. Accounts and Program Access

Where an account is required, you must provide accurate information and maintain the confidentiality of your credentials.

Program access is personal to you. You must not sell, transfer or share your account or provide another person with unauthorised access to paid materials.

6. Fees and Payment Plans

Pricing and payment terms will be disclosed before purchase.

Where you agree to a payment plan, you agree to make instalments according to the agreed payment schedule, subject to rights available under applicable law.

Failure to make payments when due may result in suspension of access while payment remains outstanding.

7. Refunds

Our Refund Policy forms part of these Terms.

Except where required by applicable law or expressly stated otherwise, purchases are non-refundable.

We do not ordinarily provide refunds because you change your mind, fail to participate or complete the program, experience a change in personal circumstances, or fail to achieve your desired trading or financial results.

8. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy available under the Australian Consumer Law or other applicable law that cannot lawfully be excluded, restricted or modified.

9. Chargebacks and Payment Disputes

If you believe a payment has been processed incorrectly, please contact us promptly so we can investigate.

Nothing in these Terms prevents you from exercising a payment-dispute, chargeback or consumer right lawfully available to you.

Intentionally submitting a false or fraudulent payment dispute may constitute a breach of these Terms, and TWJ Trading reserves its rights in relation to fraudulent conduct.

10. Intellectual Property

Unless otherwise stated, our Site, educational programs, videos, recordings, written materials, strategies, frameworks, templates, graphics, branding and other materials are owned by or licensed to TWJ Trading and protected by applicable intellectual property laws.

Your purchase grants you a limited, personal, non-exclusive and non-transferable right to use the materials for your own lawful educational purposes.

You may not reproduce, redistribute, resell, sublicense, publicly publish, commercially exploit or provide unauthorised access to our materials without written permission.

11. Acceptable Conduct

You must not use our Site, programs or communities for unlawful or fraudulent purposes, harassment or abuse, infringement of intellectual property, unauthorised distribution of program material, interference with our systems or other seriously disruptive conduct.

12. Suspension and Termination

We may reasonably suspend or terminate access because of a material breach of these Terms, fraud, unlawful conduct, serious abusive behaviour, security risks or unauthorised distribution of our intellectual property.

Any suspension or termination remains subject to rights and remedies that cannot lawfully be excluded.

13. Testimonials and User Content

Where you voluntarily provide a testimonial, screenshot, review or other content and agree that we may use it for marketing purposes, you grant TWJ Trading permission to reproduce and display that material for the purposes agreed.

We will not knowingly materially misrepresent your experience or results.

14. Third-Party Services

Our services may rely upon third-party payment processors, software, community platforms and other providers. Their products may be subject to their own terms and privacy policies.

15. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

To the maximum extent permitted by law, TWJ Trading is not responsible for trading losses or financial decisions independently made by participants in connection with their own trading activity.

16. Marketing Communications

Marketing communications are governed by our Privacy Policy and applicable Australian communications laws. Where required, marketing communications will be sent with appropriate consent and will provide a means of opting out.

17. Governing Law

These Terms are governed by the laws of Victoria, Australia and applicable laws of the Commonwealth of Australia.

Subject to rights available under applicable consumer law, the parties submit to the jurisdiction of the courts and tribunals of Victoria, Australia.

18. Changes to These Terms

We may update these Terms prospectively from time to time. Updates will not remove accrued rights or retrospectively alter an existing paid agreement where doing so would be unlawful.

19. Severability

If a provision is found to be invalid or unenforceable, it will be read down or severed to the extent necessary and the remaining provisions will continue to operate.

20. Entire Agreement

These Terms, together with applicable checkout/order terms, the Refund Policy, Privacy Policy and any specific written service agreement applicable to your purchase, constitute the agreement relating to the relevant services, subject to rights that cannot lawfully be excluded.
